Cependant, depuis la fin des années 1990, comme ailleurs dans le continent, l’heure est à la décentralisation. Les premiers de ces textes ont été les ordonnances n° 4/INT et 5/INT du 13 février 1960, portant organisation administrative générale du territoire de la République du Tchad. Ces dispositions ont été remaniées par la loi n° 15-62 du 2 mai 1962, portant organisation municipale dans la République du Tchad. Celle-ci a défini la commune3, créé une distinction entre communes de moyen exercice (maire et adjoints nommés par décret) et commune de plein exercice (maire et adjoints élus). Enfin, l’ordonnance n° 17/PR/85 du 24 juillet 1985, laquelle pour l’essentiel, a repris les principes de la loi de 1962.
